This Agreement is to confirm our understanding of
the terms and conditions under which each Member will participate in
www.spiritualrealist.com. Please read the terms of this Agreement. They
contain important obligations applicable to each and every Member of this
website.
Whenever the term “Agreement” is used it shall mean this Member Agreement, as amended, supplemented or replaced from time to time.
By becoming a Member of www.spiritualrealist.com you are agreeing to respect and to adhere to the rules set out in this Agreement, which have been designed to govern the general content and use of this website. The rules apply to all aspects of the site, all Member Submissions (as defined below), Member Homepages, Member Forums and commenting systems.
a. Abusive, harassing, or threatening comments.
b. Hateful, discriminatory, prejudicial comments.
c. Theological or metaphysical threats or any kind.
d. Profanity of any kind.
e. Derogatory remarks based on personal beliefs, gender, or personal preferences.
f. Sexual remarks or remarks where the solicitation of sex is intended or implied.
g. Comments that promote violence or illegal activities or conspiracy to commit them.
h. Satanic or black magic text, imagery or icons of any kind.
i. Submissions that contain obscene or pornographic content or images.
j. Advertisements, spamming or commercial use of any kind.
k. Distribution of unauthorized software or any material under copyright or trademark.
l. Personal information such as phone numbers, bank accounts, credit cards,

to promote or proselytize an already existing
clearly stated and available philosophy, theology,
practice, organization, group, cult, publication,
or individual except as a paid advertisement in the
Talent Exchange.
The right to advertise any such philosophy,
theology, practice, organization, group, cult, publication,
or individual is at the sole discretion of Spiritual Realist. com
and in no way constitutes an
automatic right of membership.
www.spiritualrealist.com has zero tolerance for those who abuse the rules set out in this Agreement. Abusers will be warned and, if deemed appropriate, abusers will be banned either temporarily or permanently at the sole discretion of the website Administrators. These cases are monitored on a case-by-case basis.
Image Theft, Ripping, and Plagiarism
www.spiritualrealist.com will not tolerate plagiarism or "rips", i.e., the taking of another Member’s or artist’s work and posting it as your own. Ripping is image plagiarism and theft against your peers. www.spiritualrealist.com defines image theft and plagiarism as follows:
If a Member feels that they have been ripped, or is aware that another
Member or artist has been ripped, please notify the website Administrators
via the Objection button with the following information:
1. Link to the original work;
2. Link to the "ripped" work;
3. Whether this is a constant problem with the ripper; and
4. Name and/or alias of the ripper.
Ripping allegations are very serious and are handled on a case-by-case basis. As a general rule, should the offender receive a warning for their first infraction, any other infraction may result in a ban.
www.spiritualrealist.com does not condone the uploading of pornographic materials to its database. The following guidelines shall be used to determine whether a Submission containing nudity will remain in the gallery or on the Member Homepage.
a. Is the work submitted original to the Member or does the work contain copy written material for which the Member has not received permission and has failed to manipulate to a necessary degree as to not infringe copyright?
b. Does the Submission contain explicit depictions sexual acts?
c. Is the individual(s) depicted over the age of 18?
d. Is the Submission in good taste?
Should the website Administrators deem the work to fail any of these rules, we reserve the right in our sole discretion to remove the work without notifying the Member.
www.spiritualrealist.com will not tolerate attempts to exploit or disrupt the layout, navigability, or general working of the site. www.spiritualrealist.com will issue no warnings for violations of this nature. Violators will be banned immediately upon the site administrators’ initial discovery of the disruption. All infractions are handled on a case-by-case basis. Warnings are sent via e-mail.
Any wilful and illicit use of the Objection button will be dealt with in the severest manner possible and may lead to the Member being banned in the sole discretion of the website Administrators.
www.spiritualrealist.com does not claim ownership of the materials you provide (including feedback and suggestions) or post, upload, input or submit to the website (each a "Submission" and collectively "Submissions"). However, by posting, uploading, inputting, providing or submitting your Submission to the website you are granting www.spiritualrealist.com the right to use your Submission in connection with the operation of the website including, without limitation, the right to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; and to publish your name in connection with your Submission. No compensation will be paid with respect to the use of your Submission, as provided herein. www.spiritualrealist.com is under no obligation to post or use any Submission you may provide and www.spiritualrealist.com may remove any Submission at any time in its sole discretion without notice. By posting, uploading, inputting, providing or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submission. Any rights not expressly granted herein are specifically reserved.
www.spiritualrealist.com will not be liable for any Submissions that violate the rules set out in this Agreement and subsequently cause conflict. Under no circumstances shall www.spiritualrealist.com, its Administrators, owners, creators, successors or assigns be liable for content posted by any Member, either in its form or in the consequences of its post.
CONFIDENTIALITY AND SECURITY
Each Member is responsible for maintaining his/her confidentiality and password. We make every effort to provide security, but we make no guarantee of security for material submitted online. We encourage Members not to keep any personal information on the website or its contents. At this website we encourage an open and truthful exchange of views. However, we will respond to any overwhelming complaints about any material on the site. If a member violates one of the rules set out within this Member Agreement, the Administrators will determine the appropriate consequences on a case-by-case basis.
You specifically agree that www.spiritualrealist.com shall not be responsible for any unauthorized access to or alteration of your Submission, any material or data sent or received or not sent or received. You specifically agree that www.spiritualistrealist.com is not responsible or liable for any threatening, defamatory, obscene, offensive or illegal content or conduct of any other party or any infringement of another Member’s rights, including infringement of intellectual property rights.
TERMINATION/ACCESS RESTRICTION
www.spiritualrealist.com reserves the right, in its sole discretion, to terminate your access to the website or any portion thereof at any time, without notice. www.spiritualrealist.com may also terminate or suspend your access to the website for inactivity, which is defined as failing to logon for an extended period of time, as determined by www.spiritualrealist.com. The length of time that www.spiritualrealist.com currently considers as an "extended" period of time is six (6) months. Upon termination of your right of access, www.spiritualrealist.com shall have no obligation to maintain any content or to forward any unread or unsent messages to you or any third party.
Under no circumstances shall a refund, in part or in whole, be provided to any Member for any reason whatsoever.
This Agreement shall be construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, and the parties submit to the exclusive jurisdiction of the courts of Ontario for the determination of any dispute hereunder.
